Enkai Africa Ltd Terms and Conditions
GENERAL
These Terms and Conditions (“Terms”) governs the use of the website (“Service”). The Terms
“Enkai Africa Ltd”, “We”, “Us”, “Our” refer to Enkai Africa Ltd and their affiliates.
THESE TERMS CONSTITUTE A LEGAL AGREEMENT. By your use of the Site, Products and
Services, you agree to comply with all of the terms and conditions set out herein, as amended
periodically. Enkai Africa Ltd may terminate service at any time, with or without notice, for conduct
that is in breach of these Terms, for conduct that we believe is harmful to our business, or for
conduct where the use of the Service is harmful to any other party.
We may, in our sole discretion, change or modify these Terms at any time, with or without notice.
You are responsible to read this document from time to time to ensure that your use of the
Service remains in compliance with these Terms.
These Terms and Conditions and any additional terms posted on www.enkaiafrica.com (“Site”)
together constitute the basis of the relationship between Enkai Africa Ltd and You (“Customer”)
concerning your use of this site, products and all our services.
SERVICES
We offer Customers Safaris, Hotels, flight bookings and travel services purchased from Us and
our partners. Services are provided based on facility and availability. We reserve the right to
modify, change, or discontinue any aspect of the Services at any time. Access to our services is
terminated upon expiry or termination of the Service.
The products and services displayed may not be available for purchase depending on availability
at the time of booking. The reference to such products and services on the Site does not imply or
warrant that these products or services will be available at any time. You should contact us for
availability confirmation by an authorized representative for the availability of specific products
and services available.
1. Hotel standard Check-In / Check-out time varies from destination to destination, 1200 hrs
or 1400 hrs or 1500 hrs
2. Prices are dynamic and subject to change unless the booking is put on hold-On a time
limit basis or vouchered. Rates include only those items specified in your itinerary.
3. Transfers in between 1900 Hrs to 0700 50% of Transfer supplement will be charged
4. Maximum waiting time at the airport shall be 60 – 90 minutes from the touchdown of the
flight.
5. Refund is strict as per the cancellation policy given.
6. Safari quotations are valid for the selected travel dates only and the room category and
other services, specified.
7. Request guests to be punctual for all safaris or tours and transfers. Maximum waiting time
shall be 05 minutes for SIC and 10 minutes for Private
8. Interconnecting rooms/Adjacent rooms/Rooms on same floor /rooms near to each other,
Smoking /Non-smoking rooms / are strictly subject to availability
9. For any amendment requests while on safari or tour, please request your guests to
contact you or our local emergency numbers and the request shall be subject to
availability, with/without any supplement charge.
10. Shorter stays than the booked stay and early check-out will be regarded as cancellation
and hence no refund will be provided for any un-utilized service/s.
11. We do not hold any responsibility for additional cost or adjustment which may arise as a
result of events beyond our control, such as technical problems with means of
transportation, changes imposed by re-scheduling or cancellation of flights by an
airline/train, political disturbances, natural disasters, bad weather or terrorist activity etc.
Also, any subsequent increase in the cost, which may arise from the increase of fuel
price, govt taxes or accommodation charges shall have to be charged additionally
12. We shall have no legal liability for any loss, damage, personal injury arising directly or
indirectly from any aspect of your Holiday.
13. Journey undertaken by air, land or sea is governed by the terms and conditions of the
service provider.
14. The guest booking our services is expected to provide a valid identity authenticating the
person and you shall not make a reservation in a fictitious name.
15. Showing around all the places mentioned in our packages depend upon the availability of
time and climatic conditions
16. Rates are Net and non-commissionable unless any separate confirmation has been given
in writing by any of our authorized staff or manager
17. It is the responsibility of the guest to carry all necessary travel documents such as
accommodation voucher/confirmation, passport, other valid identity proof, flight/air tickets
etc.
18. In the unfortunate event of a vehicle breakdown, we will provide you alternate vehicle.
However, the time loss due to the event will not be compensated.
19. At Religious places like Mosques, Churches, Synagogues, etc please wear decent
clothing covering all your body & At the time of tours, beach and Safari please wear
comfortable clothing etc
20. Rates quoted are based on currency displayed and for a specified no. of persons
21. In case of any immigration/Visa complications, the cancellation policy shall be applicable
in full
22. Please note that pick-up for all transfers and tours will be done as per the details in the
Safari Briefing Sheet. This document is shared closer to the date of travel and all guests
must carry the Tour Briefing Sheet during their travel.
23. Insurance is not covered in the package so please cover yourself with insurance at your
own cost before travelling on an unforgettable safari
LIMITATION OF LIABILITY
The Service is provided on an “as is” and “as available” basis and the use of the Service is at
your own risk. We make no representations or warranties, either expressed or implied,
concerning the Service, or any service or information provided through the Service. We are not
responsible for any damages, injury or economic loss arising from the use of the product or
service provided by Enkai Africa Ltd
In no event will we be liable to you for any direct, indirect, incidental or consequential damages or
economic loss arising out of the Service or in connection with our website or any other services or
products provided to you.
Enkai Africa Ltd, its officers, directors, owners, agents and employees shall in no way be liable to
You or anyone else for any loss or injury resulting from the use of the Service.

Ltd reserves all rights. Copying of part or all the contents of this website without permission of
Enkai Africa Ltd is prohibited except to the extent that such copying is necessary for availing of

THIS SITE AND ALL CONTENT IS PROVIDED “AS IS,” “AS AVAILABLE,” “WITH ALL FAULTS,”
AND WITHOUT WARRANTY OF ANY KIND. ENKAIAFRICA.COM GIVES NO EXPRESS
WARRANTIES AND DISCLAIMS:
(A) ALL IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF
MERCHANTABILITY; FITNESS FOR A PARTICULAR PURPOSE; OF THE SITE; LACK OF
VIRUSES, WORMS, TROJAN HORSES, OR OTHER CODE THAT MANIFESTS
CONTAMINATING OR DESTRUCTIVE PROPERTIES; ACCURACY, COMPLETENESS,
RELIABILITY, TIMELINESS, CURRENCY, OR USEFULNESS OF ANY CONTENT ON THE
SITE; AND
(B) ANY DUTIES OF REASONABLE CARE, WORKMANLIKE EFFORT OR LACK OF
NEGLIGENCE. THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE,
ACCURACY AND EFFORT IN CONNECTION WITH THE SITE AND CONTENT IS WITH YOU.

TITLE, OR QUIET ENJOYMENT.
In no event shall Enkai Africa Ltd be held liable for any damages or economic loss, whatsoever,
as a result of notifying any official of potentially illegal content on our website, or for providing
copies of your data files to the appropriate authorities or cooperating with law enforcement efforts
to locate persons who have posted the content that is illegal or promotes illegal conduct.
INDEMNIFICATION
You agree to indemnify and hold Enkai Africa Ltd, its affiliates, sponsors, partners, directors,
officers and employees harmless from and against, and to reimburse Enkai Africa Ltd concerning,
any losses, damages, liabilities, claims, judgments, settlements, fines, costs and expenses
(including reasonable related expenses, legal fees, costs of investigation) arising out of or relating
to your breach of these Terms or use by you or any third party of the Services.
FORCE MAJEURE
Neither party shall be responsible for or deemed in breach of these Terms because of any delay
or failure in the performance of these Terms due to any event or circumstance the occurrence
and the effect of which the party affected thereby is unable to prevent and avoid, including,
without limitation acts of God; government regulations, curtailment of transportation facilities,
strikes, lock-outs or other industrial actions or trade disputes of whatever nature (whether
involving employees of a party or a third party), terrorist attacks, haze, sabotage, riots, civil
disturbances, insurrections, national emergencies (whether in fact or law), blockades, acts of war,
(declared or not), etc. (a “Force Majeure Event”). The non-performing party shall give the other
party written notice describing the particulars of the Force Majeure Event as soon as possible.
GOVERNING LAW
These terms and conditions are governed by and shall be construed following the laws of the
United Republic of Tanzania and any dispute shall exclusively be subject to the jurisdiction of the
appropriate Courts situated in the United Republic of Tanzania.
